AltCap’s Terms of Service

Introduction
Thank you for visiting AltCap’s website. These Terms of Service (“Terms”) govern your use of the website located at altcap.org (the “Site”), operated by AltCap, a Missouri nonprofit corporation (“AltCap,” “we,” “us,” or “our”), and the information and resources we provide through it. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
AltCap is a Community Development Financial Institution (CDFI) that provides financing and business support services to entrepreneurs, small businesses, and communities. These terms apply to your use of the Site. Loan products and services are governed by separate agreements.
No Offer or Commitment to Lend
The content on the Site is for informational purposes only. Nothing on the Site constitutes an offer, commitment, or guarantee of financing. All loan applications are subject to review and underwriting, and approval is not guaranteed. Submitting an inquiry or application through the Site does not create a lender-borrower relationship. Loan terms, rates, and eligibility are determined on an individual basis and documented in separate written agreements.
No Professional Advice
Information on the Site, including articles, resources, and guides, is provided for general educational purposes. It is not financial, legal, tax, or accounting advice. You should consult qualified professionals before making decisions about your business or finances.
Use of the Website
You agree to use the Site lawfully and for its intended purposes. You may not:
Submit false or misleading information through our forms or applications
Attempt to gain unauthorized access to our systems or data

Submissions and Communications
When you submit information through the Site, such as a loan inquiry, contact form, or newsletter signup, you confirm that the information you provide is accurate to the best of your knowledge. Text Messaging
AltCap offers text message communications to applicants, borrowers, and subscribers who opt in. By providing your mobile number and opting in, you consent to receive text messages from AltCap, which may include loan application updates, account notifications, reminders, and information about our products and programs. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of applying for or receiving financing from AltCap. You can opt out at any time by replying STOP, or reply HELP for assistance. Your mobile opt-in data and consent will not be shared with third parties for marketing or promotional purposes. Carriers are not liable for delayed or undelivered messages.
Intellectual Property
All content on the Site, including text, graphics, logos, photographs, and design, is the property of AltCap or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content or brand assets without prior written permission, except for personal, noncommercial purposes such as sharing links to our pages.
Third-Party Links
The Site contains links to third-party websites, including partner organizations, educational resources, funding opportunities, and service providers. These links are provided for convenience. AltCap does not control and is not responsible for the content, policies, or practices of third-party sites. Visit and engage with them at your own risk.

Governing Law
These terms are governed by the laws of the State of Missouri, without regard to conflict of law principles.
Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and AltCap agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or our relationship with you, whether based in contract, tort, statute, or any other legal theory, shall be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and will be conducted in Jackson County, Missouri, or another mutually agreed location, or, at your election, by telephone or videoconference. Judgment on the arbitration award may be entered in any court having jurisdiction.
YOU AND ALTCAP EACH AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. NEITHER YOU NOR ALTCAP MAY ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
You have the right to opt out of this arbitration agreement by sending written notice to AltCap at the address or email provided in the Contact section below within 30 days of the date you first accept these Terms. If you opt out, you and AltCap will retain the right to bring claims in court, subject to the Governing Law provision above. This arbitration agreement does not apply to disputes relating to obligations under any separate loan or service agreement, which are governed by the dispute resolution terms of those agreements.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any separate written agreements governing loan products or services, constitute the entire agreement between you and AltCap regarding your use of the Site and supersede any prior agreements or understandings.
